Terms of Service

Your access to and use of the Website constitutes your acceptance of these Terms and of our Privacy Policy, which is incorporated into these Terms by reference. If you use the Website on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

These Terms govern use of the public Website only. They do not create, modify, or replace any agreement for reality capture, scanning, modeling, documentation, or other professional services.

Coreskan's services are provided solely under separate written agreements between Coreskan and its clients — including, as applicable, proposals, master service agreements, statements or scopes of work, purchase orders, and change orders (each, a “Client Agreement”). If there is any conflict between these Terms and a Client Agreement, the Client Agreement governs with respect to the services it covers.

We may revise these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Changes take effect when the revised Terms are posted to the Website, and your continued use of the Website after posting constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

We may modify, suspend, or discontinue the Website, or any portion of it, at any time, with or without notice. We do not guarantee that the Website will be available at any particular time, that access will be uninterrupted, or that the Website will be free of errors or defects. We are not liable to you for any modification, suspension, or discontinuance of the Website.

The Website and its content are provided for general informational purposes. Content on the Website — including descriptions of services, capabilities, technology, workflows, project examples, statistics, and coverage — is summary in nature, may be simplified for presentation, and may change without notice. You should not rely on Website content as a complete or current statement of Coreskan's offerings or of the state of any project, technology, or capability.

Nothing on the Website constitutes engineering, architectural, surveying, construction, legal, or other professional advice, and no professional or fiduciary relationship is created by your use of the Website. Website content is not a substitute for project-specific analysis performed by qualified professionals under a Client Agreement, and it should not be used as the basis for design, construction, compliance, or other technical decisions.

The Website is an invitation to learn about Coreskan; it is not an offer to provide services on any particular terms. Submitting an inquiry through the Website does not create any obligation on Coreskan to respond, to provide a proposal, or to perform services, and no communication through or about the Website creates a binding commitment by either party unless and until a Client Agreement is signed. Coreskan may accept or decline any prospective engagement in its discretion.

The Website includes marketing content such as case studies, portfolio material, project imagery and video, interactive visualizations, statistics, capability descriptions, references to accuracy or level-of-detail standards, timelines, and coverage maps. This content is illustrative. It describes selected past work and general capabilities as of the date prepared; it is not a representation, warranty, or guarantee of the scope, accuracy, schedule, deliverables, pricing, or results of any current or future engagement.

The scope, specifications, accuracy requirements, schedules, deliverables, and commercial terms applicable to any actual project are established exclusively by the Client Agreement for that engagement.

The Website and all content on it — including text, graphics, logos, photographs, video, audio, renderings, point-cloud and model visualizations, portfolio and case-study material, downloadable media, page designs, software, and the selection and arrangement of all of the foregoing — are owned by Coreskan or its licensors and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

Except for the limited license in Section 11, nothing in these Terms grants you any right, title, or interest in the Website or its content. Portfolio and media content may not be copied, republished, distributed, or used commercially without Coreskan's prior written permission.

“Coreskan,” the Coreskan logo, and related names, marks, and designs are trademarks of Coreskan, LLC. Other names and marks appearing on the Website — including client names and marks shown in portfolio or client-recognition contexts — are the property of their respective owners and are used for identification only. No trademark license is granted by these Terms, and no use of any mark on the Website implies endorsement or affiliation except as expressly stated.

Subject to these Terms, Coreskan grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Website and its content for your personal, informational, or internal business evaluation purposes. You may print or save individual pages for those purposes, provided you retain all proprietary notices.

In connection with the Website, you agree not to:

• use the Website in violation of any applicable law or regulation, or for any fraudulent or malicious purpose;
• copy, scrape, harvest, or systematically extract content or data from the Website, whether manually or by automated means, except as permitted by a search engine's standard indexing;
• interfere with or disrupt the operation or security of the Website, or attempt to probe, scan, or test its vulnerability without written authorization;
• circumvent or attempt to circumvent any technical measure protecting the Website, or introduce viruses or other harmful code;
• submit false, misleading, or impersonating information through Website forms, or submit content you do not have the right to provide;
• use Website forms to send unsolicited commercial messages or bulk submissions;
• frame, mirror, or embed the Website or its content without written permission; or
• remove, obscure, or alter any copyright, trademark, or other proprietary notice.

The Website provides forms through which you may voluntarily submit information — for example, project inquiries submitted through the contact form. You are responsible for the accuracy of the information you submit and represent that you have the right to provide it. Personal information submitted through the Website is handled as described in our Privacy Policy.

Ideas, suggestions, or other feedback you choose to send about Coreskan or the Website are provided voluntarily, and Coreskan may use them without restriction or obligation to you, except with respect to personal information governed by the Privacy Policy.

The Website allows prospective candidates to express interest in employment and to submit application materials, which may include a resume. You represent that the information you submit is accurate and your own. Submitting an application or expression of interest does not create an employment relationship, an offer of employment, or any obligation on Coreskan to respond, interview, or hire. Application materials are handled as described in our Privacy Policy.

The Website may contain links to, or load limited content from, third-party websites and services that Coreskan does not control. Links and references are provided for convenience only and do not constitute endorsement. Your use of third-party websites and services is at your own risk and subject to their own terms and policies.

The Website uses modern browser technologies, including interactive 3D graphics, and its appearance and performance may vary by device, browser, operating system, and connection. We do not warrant that the Website will be compatible with your hardware or software, that content will render identically in all environments, or that the Website or the servers that make it available are free of viruses or other harmful components. You are responsible for maintaining your own device security.

THE WEBSITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, CORESKAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NOTHING IN THIS SECTION LIMITS ANY WARRANTY EXPRESSLY SET FORTH IN A SIGNED CLIENT AGREEMENT WITH RESPECT TO THE SERVICES IT COVERS.

TO THE FULLEST EXTENT PERMITTED BY LAW, CORESKAN AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, CORESKAN'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. This Section applies to the Website only and does not limit any liability provisions of a Client Agreement with respect to the services it covers.

You agree to indemnify and hold harmless Coreskan and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Website.

These Terms and any dispute arising out of or relating to the Website are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. You and Coreskan agree to the exclusive jurisdiction and venue of the state and federal courts located in the Commonwealth of Pennsylvania for any such dispute, and each party waives any objection to such venue.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

Coreskan's failure to enforce any provision of these Terms is not a waiver of that provision or of the right to enforce it later. Any waiver must be in writing to be effective.

These Terms, together with the Privacy Policy, are the entire agreement between you and Coreskan regarding use of the Website and supersede any prior understandings regarding the Website. For clarity, they do not supersede or amend any Client Agreement.
